Dear Sir or Madam,
I am writing to inquire about the progress of my request under the Freedom of Information Act 2000.
I am having trouble understanding the reason for the delay. If the information I have asked for is not covered by an exemption then the HSE are legally obliged to provide it and not legally required to seek permission from any third parties in order to do so. If the HSE considers the information to be exempt then I should be told what exemption the HSE is seeking to apply.
Please explain what permissions are being sort and why and please give me an indication of when I am likely to receive a response.

I am writing to request an internal review in relation to the handling of my request dated 6 June 2008 (your reference: Ref: RMJS-7E5J9B). The deadline for a response was 28 May 2008 but I have yet to receive all of the information I have asked for or be told of a specific exemption which means the information need not be released. I was told that permission was being sought from a third party to disclose but I was never told who that party was or why permission was needed.

Thank you for your request for an internal review following your Freedom
of Information request for information on the sunbed industries, it was
received by HSE on 16th June 2008.
I have spoken to the FOI officer who is dealing with your case, and
would like to apologise for the delay in you receiving your response. A
response is to be sent to you later today and hopefully this will answer
your original request.
If however, you are still not happy with the outcome of your request,
then can you please let me know if you still wish for me to proceed with
your request for an internal review - I will need this in writing as per
the appeals procedure which will be detailed in the letter which you
will receive today.
With regards to your mail message asking for an internal review, you say
that you were told that 'permission was being sought from a third party
to disclose but I was never told who that party was or why permission
was needed'. Under the Freedom of Information Act we are not obliged to
divulge particulars of a third party to applicants. It is not our
policy to forward this type of information to our applicants.
I hope that you will find this response satisfactory.

This information can be disclosed and copies are enclosed. The
documents marked '*' have been redacted to remove personal information
(Section 40).
